Judge’s Ruling May Lead to New Evidence in Jan. 6 Case

In a recent development in former President Trump’s election interference case, the judge granted the request of special counsel Jack Smith to submit an extensive brief on presidential immunity.

Smith has until Thursday to file his initial brief outlining how the Supreme Court’s ruling on immunity applies to Trump’s case. He sought permission to file a 180-page document, exceeding the usual limit of 45 pages.

Trump’s lawyers objected to the request, claiming it was excessive and politically motivated. However, the judge allowed the filing, which will likely be partially sealed to protect sensitive information.

Last year, Trump pleaded not guilty to charges of trying to overturn the 2020 election results. The Supreme Court previously ruled that Trump has immunity for official acts as president.

The judge’s decision to allow the lengthy brief acknowledges the complexity of determining which charges against Trump can proceed, given the Supreme Court’s ruling.
