Threat of lawsuit derails final vote on Flagler Beach’s controversial Veranda Bay project

A final vote on the controversial Veranda Bay development was tabled Thursday night by the Flagler Beach City Commission under the threat of a lawsuit by opponents of the large-scale, mixed-use proposal that would annex 899 acres within the municipality’s jurisdiction.

According to Flagler Beach City Commission Chair Scott Spradley, the city received a letter late Wednesday from S. Brent Spain, an Orlando-based attorney representing Preserve Flagler Beach and Bulow Creek, a non-profit that has fought the project, and Stephen Noble, a resident of John Anderson Highway adjacent to the land in question.

The letter claims that if the commission were to approve the annexation along with amendments to the zoning map and comprehensive plan, the new city boundaries would create what would be considered an “enclave” of eight privately-owned properties that would remain in the county’s jurisdiction…
