Olyphant Borough Council will decide the future of a disputed borough-owned lot on Delaware Avenue as the attorney for the winning bidder of the property threatens litigation.
For the past month, borough officials and attorney Michael Pisanchyn, who represents the Bar and Company owner Mike Dennin, have clashed over a vacant lot at 105-109 Delaware Ave., which Dennin won at a borough auction last month after he outbid Queen City Tavern owner John Basalyga for the land next door to Basalyga’s tavern. Following a bidding war between the men during the Dec. 3 auction, Dennin’s winning bid came in at $130,000 for the lot, which was appraised at $71,300, according to the borough.
Olyphant initially set Dec. 30 as the deadline for Dennin to sign a sales agreement to buy the land, but the borough extended it until noon Monday after discovering the Queen City Tavern’s deck encroaches on the land. Last week, borough manager and solicitor C.J. Mustacchio said Basalyga could have a claim to keep the deck through adverse possession, pointing to plans submitted to the borough in 2000 that showed the deck was already there…
