Felony complaint outlines ‘reckless behavior’ that caused Binghamton fatal crash

In a two-car fatal crash authorities have said was caused by road rage , one driver tried to overtake the other vehicle, and the other driver swerved to push the car off the road, according to documents filed in Binghamton town court.

The crash, which happened around 3 a.m. Sunday at the intersection of Morgan Road and Cobblestone Court, resulted in the death of 29-year-old Charles Burrell Jr., of Conklin. Two drivers, 20-year-old Cody Diffendorf, of Kirkwood; and 26-year-old James Macdowall, of Binghamton; have been charged with second-degree manslaughter.

At a news conference Monday , Broome County Sheriff Fred Akshar said Diffendorf and Macdowall had engaged in “reckless behavior” leading up to the crash, while traveling south on Morgan Road, a two-lane road that does not have a paved shoulder…
