Proposed ordinance lowers threshold for resisting arrest charges

BISMARCK, N.D. (KFYR) – Bismarck City Commissioners have paved the way for a new ordinance that makes it easier for police to charge someone with resisting arrest.

Currently resisting arrest is a Class A misdemeanor under state law. Those charged go to district court and face penalties of a $3,000 fine and/or a year in jail. However, officers must first prove they or others were under a substantial risk of bodily harm.

Under the new ordinance, the threshold to charge someone would be lower, but the case would go to Bismarck municipal court…
