Governor Leaves Menendez Brothers Case to New DA

Additional Coverage:

California Governor Gavin Newsom has passed the decision on the Menendez brothers’ case to Los Angeles County’s newly elected District Attorney, Nathan Hochman.

Hochman has stated that he will review the case before making a decision. The outgoing District Attorney, George Gascón, supported resentencing and releasing the brothers.

A hearing is scheduled for December 11th, where a judge will consider arguments for re-sentencing Erik and Lyle Menendez. This could potentially lead to a parole board hearing and their release.

The brothers’ lawyer, Mark Geragos, plans to request a conviction change from murder to manslaughter. As the Menendez brothers have already served more than three times the maximum sentence for manslaughter, they would be eligible for immediate release.

Governor Newsom has not indicated whether he will wait for the judge’s decision before considering clemency. However, given the controversy surrounding the case, he is likely to delay his decision until a ruling has been made.
