Neely death not caused by chokehold, says medical examiner

Expert Disputes Chokehold Death

A forensic pathologist testified that Jordan Neely’s death was caused by a combination of factors, including mental illness and substance abuse, rather than a chokehold. The pathologist, Dr. Satish Chundru, contradicted the medical examiner’s finding that Neely died from compression to his neck.

Defense Challenges Prosecution’s Theory

Chundru’s testimony supported Daniel Penny’s defense, who is charged with manslaughter in Neely’s death. Penny’s attorneys argued that he acted to protect others and did not intend to kill Neely.

Toxicology Results Questioned

Chundru criticized the medical examiner for issuing a ruling before toxicology tests were complete. The prosecution’s witness, Dr. Cynthia Harris, maintained that her decision was based on autopsy findings and video evidence.

Character Witnesses Testify

The defense also called character witnesses to describe Penny as a compassionate and empathetic person. His sister and mother testified about his upbringing and values.

Prosecution Raises Concerns

The prosecution challenged Chundru’s credibility, suggesting he performed an excessive number of autopsies per year. They also presented evidence that Penny may have lied during an interview with police about the chokehold.

The trial continues with further cross-examination of Chundru and the presentation of additional evidence.
